Article1 Contractual Relations
The business relationship between DANISH BEARS APS (hereinafter gayshop.dk) and the customer is governed by the General Terms and Conditions below in the version valid at the time orders are placed. Any deviating terms of the customer shall not be recognized by gayshop.dk unless these have been previously expressly approved in writing by gayshop.dk.

Article2 Formation of a Contract
When an order is submitted, a legally binding sales agreement comes into force between the customer and gayshop.dk. When submitting an order, the customer expressly declares that he is at least 18 years of age and that he will only allow items ordered to be used by persons who are also at least 18 years of age.

Article3 Cancellation
The customer can cancel the sales agreement in writing or by email within two weeks of receiving the goods. The costs of returning the goods are to be borne by the customer. This right of cancellation does not apply to audio or video recordings (e.g. DVDs, video cassettes, CDs) where the seal has been broken and/or which have been used. The right of cancellation also does not apply to goods which are naturally not suited to being returned (personal hygiene items after the packaging has been opened, pharmaceutical and cosmetic items).

Article 4 Delivery
Gayshop.dk provides the customer with the goods ordered for collection. Upon submitting his order, the customer authorises the courier company VIP Spedition ApS to collect the goods ordered from gayshop.dk and deliver these to the address provided by the customer. Indications of delivery times are not guaranteed insofar as these have not been guaranteed by VIP Spedition ApS. The customer is liable for the accuracy of the delivery address provided. Gayshop.dk is not liable for delays or inability to deliver goods due to incorrect or insufficient details having been provided by the customer. Gayshop.dk guarantees the customer that the goods will be packed in fully neutral and discrete packaging.

Article 5 Payment
The customer shall settle the purchase price of his order in advance by credit card or bank transfer. Customers with a delivery address in Denmark or Germany also have the option of paying for the goods order on delivery (COD). When paying by credit card, the customer guarantees that he is the holder of the credit card indicated and that he is authorized to use it to fulfil the sales agreement. When the sales agreement comes into being he authorizes gayshop.dk to debit his credit card with the purchase price due. The customer can also pay the purchase price due with bonus points he has collected, assuming sufficient credit. In this case, the customer authorizes gayshop.dk to debit the customer's bonus point account with the number of bonus points due.

Article 6 Retention of Title
The goods delivered remain in the ownership of gayshop.dk until the full purchase price has been paid.

Article 7 Liability and Returns
If the item purchased is defective, the customer can demand subsequent performance (remedy of the defect, or replacement). In such a case, the customer must inform gayshop.dk of the defect without delay, in writing, by telephone or by email, and demand a return number. This is then to be indicated on the return. The customer must ensure that the item returned has sufficient postage. As soon as the defect is confirmed, the defective item will be exchanged free of charge for an item free of defects. If it is not possible to replace the defective item with a fault-free one, either because this item is no longer available, or the replacement is also be clearly defective, the purchase price shall be refunded to the customer. If, however, the defect cannot be confirmed, the returned item will be sent back to the customer at his risk and cost. Further claims from the customer, regardless of the legal basis, are excluded.

Article 8 Data Protection
(1) Gathering, processing and using personal data
Gayshop.dk commits to protect the privacy of everybody shopping at stores operated by gayshop.dk and to treat personal data confidentially. Data received from the customer is only gathered, processed and used to process the sale agreement.
(2) Correction, freezing and deleting personal data
After registering, Gayshop.dk customers can view and edit their own user information in the protected area of the homepage at any time. Should they wish to have their user information deleted, customers can contact gayshop.dk at info@gayshop.dk.

Article 9 Applicable Law
Danish law is to apply to the exclusion of the UN sales law.
